IDFI's Statement on the Unlawful Imposition of the Fine on the Organization's Executive Director

On February 6, 2025, the Tbilisi City Court concluded consideration of the administrative offense case against IDFI's Executive Director, Giorgi Kldiashvili. Judge Nino Enukidze found Giorgi Kldiashvili liable based on disputed photo-video materials and fined him 5,000 GEL.

 

The Ministry of Internal Affairs drew up 4 administrative offense protocols against Giorgi Kldiashvili, claiming that he was "artificially" blocking Rustaveli Avenue on different dates during the ongoing protest in front of the Parliament building.

 

Based on the motion of Giorgi Kldiashvili's lawyers, the judge consolidated the four ongoing cases for joint consideration but did not satisfy the motions of crucial importance to the case.

 

During the hearing, the lawyers disputed, among other things, the legality of processing photo/video materials attached to the case by the Ministry of Internal Affairs. At the same time, written appeals were submitted to the court that were sent before the hearing to the Patrol Police Department of the Ministry of Internal Affairs, LEPL Public Safety Management Center "112" and the Personal Data Protection Service. The lawyers also filed a motion to question as witnesses at the hearing the patrol inspectors who drew up all four offense protocols and other persons involved in identifying Giorgi Kldiashvili.

 

Since the lawyers had not received the responses to the written appeals sent to the relevant agencies before the start of the hearing, they filed a motion to postpone the hearing, but Judge Nino Enukidze did not postpone the hearing, nor did she grant the motion to question patrol inspectors and other persons as witnesses in court. The judge ignored the provision of the Constitution of Georgia, according to which evidence obtained in violation of law has no legal force, and also violated the adversarial principle, which gives parties the right to refute materials submitted by the opposing party.

The judge of Tbilisi City Court found Giorgi Kldiashvili liable based on photo-video materials whose lawful processing has been disputed. Moreover, in part of the photo-video materials, Giorgi Kldiashvili is not identifiable, while in others, it is impossible to determine his exact location.

 

Similar proceedings are ongoing against hundreds of participants of the continuous protest, and observing the events unfolding in court once again confirms that the judiciary is an accomplice to systemic repression.

 

It is noteworthy that the Ministry of Internal Affairs initiated similar proceedings against IDFI's several employees (5 ongoing cases), including the co-founder of the organization, and on December 2, 2024, police forces illegally arrested the Head of the Rule of Law and Media Freedom Direction of IDFI, who was found liable by the judge of the Tbilisi City Court despite the lack of relevant evidence.
