On September 25, 2013 IDFI addressed to the LEPL National Bureau of Enforcement demanding the information about funds transferred to state budget through the use of plea bargaining agreements. According to the received documents, during 9 months of 2013 (January 1st-September 25th) total amount of the funds transferred to the state budget through the criminal fines, damages imposed to the state, bails and plea bargaining agreements sums up to 54 722 173 GEL. As for money transferred through the use of plea bargaining agreements separately, according to the obtained documents, LEPL National Bureau of Enforcement does not run separate records of these data.
In March 5 2013, IDFI had addressed to the National Bureau of Enforcement with the request of information about funds transferred to state budget through the use of plea bargaining agreements in 2009-2012 years. This request was fully complied and provided the data of 2009-2912:
2009: 8 040 392.81 GEL
2010: 42 361 459.28 GEL
2011: 51 009 723.78 GEL
2012: 38 627 586.89 GEL
IDFI contacted the National Bureau of Enforcement to find out the real reason of not publicizing the information about funds transferred to the state budget through the use of plea bargaining agreements in 2013. It is notable that the similar data of 2009-2012 years was fully provided in March of 2013. During the phone conversation, it turned out that since 2013 statistics department of the National Bureau of Enforcement has moved to another system, which does not allow them to separate funds transferred through the use of plea bargaining agreements from the total amount.
Due to the high interest from the society towards the funds transferred to budget through the use of plea bargaining agreements, IDFI appeals to the National Bureau of Enforcement to continue the practice of keeping the separate records in order to avoid the perception of this fact as an attempt of concealing the data. This will also solve the issue of lack of transparency of the funds transferred to budget through the use of plea bargaining agreements.
